Question in my dirvorce decree it says I agreed to pay child support of 1000 a month but since the dirvorce my three boys have been staying with me. Can i get this change. I live in Dallas, Tx. Also, my ex is engaged to her fiance' there is a felony charge assault with deadly weapon againist him when he beat her 2 years ago. I want full custudy of the boys and have her pay child support. Can I do this also

Yes, and yes.

It's important to get your Motion for Modification filed SOON. Your Judge can make the change (that is, stopping your child support) retroactive to the time you serve Mom with the Motion (remember that it may take 11 months to get to trial), but not any earlier than that. Every time the first of a month goes by, you've lost $1000.

For a custody fight, plan to bring your lawyer at least $7500 up front. Custody cases are always expensive and time-consuming.
