Legal Question in Family Law in Texas

Question, I live in Texas and have sent my spouse a waiver of service, (is a waiver of service the same as the waiver of citation) His question is will it be legal if he gets it notarized in Virginia were he lives, even though it states State of Texas where its to be notarized. or is there another form I need to send him

He can use that form. But where is says "State of Texas", just have him cross out the word "Texas" and write in "Virginia". Where it says "County of ________", just have him fill in the county where he will have it notarized. Other than that, the form is fine.
