Legal Question in Family Law in Texas
My question is if I had told my baby daddy that I was pregnant and he tells me to drink something to stop it and in the 9 months of pregnancy he never asked about the baby or anything. So my boyfriend at the current time found out I was pregnant by another guy and still stayed with me, he then asked what my baby's dad had said when I told him and I told him he wanted me to stop it. So for me after he told me that, he was no longer my baby's father. My boyfriend then said to leave it how it was and offered to give my baby his last name so we went ahead and did that. And since the baby's dad was never around during my pregnancy at all I told him that he didn't have to worry about anything because he wasn't the dad and he never replied back. To me after he told me to drink something to stop it that's when to me he wasn't the father anymore. And plus he didn't think it was his, he wanted a DNA test because he thought it was my boyfriends. And now apparently the mom wants to go to court for a DNA test. And my question is, what would happen since he really is the dad after I told them it wasn't?
1 Answer from Attorneys
Grandmother's have no interest and no legal standing in your case. What she wants is irrelevant.
The man can file a paternity lawsuit and ask for DNA testing.
What was said before the baby was born is irrelevant.
Neither of you were under oath at the time.
So wait and see if he actually hires an attorney and files a lawsuit. If so, hire an attorney and respond to it.
