Legal Question in Family Law in Texas
Questionable ethics of judge?
My brother's wife had $30,000+ in credit card debt that he did not know about, because it was mostly used for gambling. She told him she had a boyfriend & didn't intend to stop seeing him. She has been known to use pot. She lied to the judge. The judge ignored the boys' request to live with their dad (ages 12 & 14), & ruled that my brother is responsible for all of his wife's debt. Everything. He will have a negative $900. at the end of the month. She will have a surplus of $1500+. Her lawyer and the judge just got back from vacation together. They are fishing buddies. Several lawyers have told us that if you go to this judge's court, against that lawyer, you WILL lose. Can the judge order anyone to pay more than they make, and who can we make a formal complaint to about this judge? We are aware that we can request a jury trial and intend to do so. I realize the lawyers here in town do not want to speak out against another lawyer or a judge, but we have little to lose and hopefully, some sense of justice to gain. Thanks...

If 30 days have not gone by since the ruling you describe, you can request a new trial. That will extend the time you have to make an appeal in this matter. You should see a lawyer to represent you in this matter. If you want to make a complaint against the lawyer, report his conduct to the local grievance committee. If you want to make a complaint against the judge, report him to the Judicial Ethics Commission.

You didnt say if this was a temporary or final order. If temporary, then can ask for jury to assist with primary custody issue. Not sure what you can do about the relationship between the judge and attorney. Tough call.
Good luck
