Legal Question in Family Law in Texas

My ex has quit paying on bills that the judge ordered him to pay. They are in my name and have now ruined my credit because I can't pay them. I have all the proof. My question is, "what papers do I have to file to get a court date?" We did our divorce without attorneys. I just need to get back in court because it's up to about $7,500 now that he owes.

Thank you,

Lori

You'd need to file a Motion to Enforce the Divorce Decree, pointing out what he was ordered to do and hasn't done, and asking that the court set a hearing. You'll need to notify him first of the motion (send him a copy of it the day you file it), and later notice of the hearing. I'd do both by certified mail (first class mail is legally sufficient, but he can always claim he didn't get it and every so often the judge will go for that--certified, you have real proof), and I'd also send him a certified letter prior to filing the motion telling him it's his last chance to comply and giving him a date by which you expect him to comply or you're going to file. Good luck.
