raising granddaughter

Tori my 5 year old granddaughter has been living with me for 3 years. Now the mother wants her back. She is my sons child and he never married the mother. I have never received and financial help for neither parent. The child is happy and secure now and doesn't want to leave my home. I don't want to let her go either, she is like my own child now. What can we do?

If you have had the child over 6 months (which you have), then you can ask the court to grant you conservatorship over the child. (It's similar to guardianship but called something different in the family courts). You would also be entitled to receive child support from both parents of this child. They would have court-ordered access to the child. You would want to be the person designated by the Judge to make decisions regarding the child's residence.

If the mother comes and picks up the child, then you need to see an attorney immediately because your "standing" to go to Court will go away.
