Raising my husbands child

My step daughter lives with us and he is paying his x for me to raise her I need some help its causing problems . the mother wants her but really she is with us and she still gets the money ,will she have to pay us back for the money? she gets her when its convinient for her. in the last 6 mon. we've had her counting today 114 days

I agree with the others. Get a motion to modify on file. Seek temporary orders to stop the child support and maybe get it flowing to you. I love to belp you if you live in North Texas.

Your story is a common one that I hear weekly.

You need to file a modification while you have her with you. It appears she has been with you for approx. 6 months.

She will not be ordered to reimburse him -- but she will be ordered to pay some child support to him.

Whereever you are you need to see a lawyer about a Motion to Modify the Divorce Decree re: custody. If you and your husband actually have possession of the little girl, then for god's sake go see a lawyer about getting a court order - particularly if your husband is paying child support.

Mr. Grissom is correct. The fact that you have had your step daughter for so long would be a defense to not paying child support, but the court's will not make her pay back any money from the past if child support has been taken out of your husband's pay. The only way to stop that is to file a motion to modify. Your husband has been sitting on his rights and nothing is going to change until you go back to court.
