Legal Question in Family Law in Texas

ex ran to Tx

My ex is in Tx due to the Hurricane and I am in CT. We have a visitation schedule issued by a New Orleans court saying I am responsible for transportation cost because my ex dosen't drive. I plan to stay here in CT rather than try to move back to LA and would like to know what is policy for air travel? Would I be responsible for that I would it be 50/50? Woould/Could a courtask/order me or my ex to move to a neutral city or a city where one parent is already established?

Re: ex ran to Tx

Katrina threw the LA order into a cocked hat. Your best bet is to register the LA order (you'll need a certified copy - how you get that at this point is anybody's guess) here in CT. Then you ask the CT court to modify the order to conform to the new situation. They won't ask either of you to move. What they will do is adjust the child support to reflect dad's travel expenses. We can help you with all of this at $200/hour. You can try to do it yourself, but my guess is it will be too much, but you can try.

You will need to register the New Orleans order in CT and then request a modification. A court in CT may or may not adjust the child support to reflect the cost of travel expenses. However, you should request it. Otherwise, a court will look at both of your incomes and financial circumstances when deciding how to allocate the travel expenses.
