Legal Question in Family Law in Texas

i recently went through a child custody case for my 9 yr grand-daughter whom i have raised since she turned 3 she and her dad moved in with me after her mother decided she was trired and didnt want to play mom anymore my son got put in jail 5- 26- 2010 on dwi charges the judge hearing the case stated that since she did have a mom that the custody would go to mom even though she has never been that involved in her life my question is why did i not get the chance to have full custody while my son is in jail? and why did the judge just assumed that the child is better off with her mom instead of with me who has been with her all her life

These are questions that you need to ask you attorney. He or she should be able to explain that to you.

If you did not have an attorney, that would explain part of your inquiry. There are certain presumptions under the law that must be overcome in certain ways. It would be unlikely that a layman could navigate those waters.
