I have recently filed for divorce

And my soon to be Ex husband refuses to leave the home

The mortgage has not been payed in nearly 5 months

Is there any way he can be evictedthe home is nearing foreclosure status

And he still refuses to leave Ian currently in school and I don't make enough to cover the mortgage payment the home was bought solely under my name and his no where on the bank or mortage papers what would my next step be

If the foreclosure goes through, your husband will eventually be evicted. So will you.

What do ypu plan to do about the house? Do you have some plan to stop the foreclosure?

If you want to make him leave, you can ask the Court for temporary orders (in your divorce case) that award to you the exclusive use of the house. It requires notice and a hearing.
