Legal Question in Family Law in Texas

i am recently married and have a child from a previous relationship but we were not married and my sons biological father never signed the birth cert. now that i am married my husband has stepped into the role of my childs father but has not yet adopted him but he is as far as my child and i are both concerned his father. but now my sons biological father wants to see him but his lifestyle is not anything i want my child around and as i said before he never signed the birth certificate and has never paid or been court ordered to pay child support so my question is does he still have any legal rights? do i have to let him see him? and how would my husband go about adopting my son what do we need to do?

In the absence of a court order, the biological father has no legal rights. He is a stranger to your child. You do NOT have to let him have any contact with the child.

Even so, his rights would have to be terminated before your current husband could adopt the child. It's called a petition for termination and for adoption by a stepparent (it can all be done in one lawsuit).
