Can you record a conversation with your husband without him knowing it and use it to prove his mental instability?

Yes.
As long as you are a party to the conversation, you can record it, and you don't need anybody's permission. You don't even have to tell him that you're doing the recording.
You may NOT record other people's conversations without their permission (the "climbing the telephone pole to tap into the line" situation).
