I was in a relationship with my boyfriend for 2 and a half years. we have a 4 month old son now. He was abusive and just recently I called the police on him and hhe is in jail and has 2 charges pending. I want to have full custody of our son, how do I go about doing that and will I need to hire an attorney?

Unless you have been to court and have a court order establishing paternity of the child, your boyfriend is (legally) a stranger to the child, and has no rights at all (and no duties either). No custody, no visitation, nothing.
To establish the father's rights (and duties), somebody would have to go to court and file a paternity suit. Or the two of you could get married (which I don't recommend).
