Legal Question in Family Law in Texas

I was in a relationship with my sons dad for 8yrs. I filed a tax return w him as 'married filling jointly' after 6yrs of being together. We're now common law married (as far as I know). When he left, he took my (at the time 6yr old, now 8yr old son) w him. He tells the court we're in fact married. He was awarded custody of my son. I pay child support. The case initially ran as a divorce but was reset and went to the Attorney General. I want to marry the man Ive been in a relationship with, that is not my sons father. My question: Can I legally marry a man as if I am not common law married?
