Legal Question in Family Law in Texas

I was in a relationship for 8 years and got married legally in New York in 2011. and I carried a child in 2008 and did the artificial insemination myself but she was in her life for 4 years with me...while I gave birth and so on. We have been apart for 2 years and now that Texas has made gay marriage legal..does she have rights to my daughter? I am the only one on the birth certificate. We didn't get legally married til my daughter was 3...

You didn't provide a lot of facts, but from what you've written, if you gave birth prior to the marriage, she probably does not have any rights. You should consult with a family law attorney so he or she can ask you a lot of questions and then tailor the advice to your particular facts.
