relinquishment of parental rights

would me and my husband have to hire an attorney? because his ex wife wants to give up her rights. she hasn't seen her daughter in 8 months and doen't wont to because the last time she had her daughter for a weekend visit she picked up a man that she didn't know and he was trying to touch my husbands 8 yr old daughter where he shouldn't and she told her mother what he was doing in the car she told her she would just have to deal with it until she figured out what to do about it. she never went to the police so when she told us about it we went to the police and filed a report. but when she came for her next visit her daughter was crying so we didn't make her go for the weekend. but now her mom says just get me the papers so i can just give up my rights and you can adopt her because i dont want to see her any more. when we went to court last year the judge had it put in a court order that no one was to do anything that would hurt her in any way or put her in any danger of any kind. so would we have a chance in court for to relinquishment of parental rights or can we just have an attorney draw up the papers and let her sign them like she wants to do?

If you want to adopt the little girl, then you should obtain a lawyer unless you have the ability to do this yourself. I do this all the time so it is not a big deal for me, but I don't know if you want to do the research necessary to do it yourself. It's not impossible, but it would be a lot of work and you could make a mistake which could be expensive in the long run. If you are in TX, contact me by e-mail if you want my assistance.
