Legal Question in Family Law in Texas

Relocating

My children and I are residing in substandard living conditions. No water, heat, etc. I plan to relocate to New Mexico to be near family who will help us. My husband and I aren't on good terms and I plan to divorce him in the future, but need to relocate NOW! What problems could this pose especially if he disagrees with my decision to move?

The biggest problem he could cause would be to file for divorce on you here in TX and possibly seek a TRO to prevent you from taking his children out of state. That takes some money and he apparently hasn't been taking care of you or the children, so I don't know where is money is going. You could file for divorce in NM as soon as you get there. Most states have residency requirements for granting a divorce (possibly 6 months). I don't know what NM says. You could contact a women's support group in NM to assist you. Good Luck.
