Relocation with minor child

My husband and I have been separated for 4 years. Do I have to notify him I plan to move out of state since there is no child custody order or divorce filed?

I don't know what your entire situation is, but I would suggest getting an Order of the Court using a Suit to Affect Parent Child Relationship at a minimum. I have seen this situation result in custody being granted to the father (rarely). Or you could go ahead and file for divorce and get Temporary Orders to remove the child from the jurisdiction. Or you could go ahead and move and see what happens.
