Legal Question in Family Law in Texas

Re-married ex still uses my last name?

My question is one of curiosity: What might the reasons be for my re-married (over 8 years ago) ex-wife to continue to use my last name for the past 11 years? I understand why, for the sake of younger children of the divorce, but my kids are both college age. Is there a possible financial gain for her at any point? She uses my last name in correspondence, and for awhile wanted my child support checks made out to her with my surname. I refused. She still endorses the check with my last name. Should I be suspicious--and what recourse would I have for any possible ''strategies'' she has going?

Generally speaking, she can use any name she wants as long as she's not evading creditors or hiding from criminal prosecution.

Perhaps she never changed her social security card and/or driver's license.

I suggest you run your credit report every 6 months to make sure that no one is assuming your identity. If so, go to the police and report identity theft. Identity theft is becoming more common in Harris County.

Good luck!
