remarried ex wife asking for child support

ex re marrried ! lives with new husband. have joint custody of 2 children 11 and 8... no primary ..split custody 50/50 in our decree ..she agreed so we could get divorced she re married exactly 31 days after our divorce was final .. kids travel 4 miles between homes and no problems they enjoy see both parents . she is trying to now 1 1/2 yrs after divorce was final to become primary and ask for child support ? she filed papers for court hearing even though it says in our decree have to request mediation first before filing for court hearing ? my question is I too could file for primary conservership of children and ask for child support correct ? Does the ex wife and her new husband income come into play ? I'm a single father not re married and make only 50k year and raise my children 50% of the time. All the expenses I incurre when kids with me I pay for .. plus I pay per decree 190 for my daughters gymnastic class monthly. I know for fact the ex wife and new husband make well over 100K yearly ? they have joint checking acct so does his income factor in ? If anyone needs $$ is me the single father that struggles monthy with bills and providing the best home for my children ! no criminal or other issues involved ??

You could respond to your X's filing by counterclaiming for primary and child support. Better get a lawyer. You could also ask to enforce the mediation provision.
