I am divorcing my husband of 21 plus years as of 04-2009.. he earned156k in 2008 and is ''now saying'' his gross annual income this year wil be ''reduced'' down to 93k (ive been a stay at home mom and have no real skills in work force (not to mention im 45 years old) and he's been convicted for family violence charges within the last year.... (on ''wich income'') will the child support and spousal maintenance request im asking will the court go by?

His income will be based on the evidence shown to the judge. It's not as black and white as you want it to be right now. He "says" his income is $93K now. How convenient. My clearest and best advice to you is to get a lawyer right away. The longer you wait, the tougher it gets. No money? Talk to the lawyer about getting your soon-to-be ex-spouse to pay. Sometimes a good lawyer can make that happen. Wouldn't that be nice. Good Luck.

Sounds like you want a black and white answer to your question and it would be speculative from any attorney to answer that. On the other hand, depending on the evidence presented to the court, the court will make a ruling in relation to child support, spousal maintenance and other issues that may be at play. You need to obtain an attorney to help you get the best possible outcome for you.

As to child support and possible spousal support, there are upper limits to what you can get. At either income, it's very close to being maxed out. To get more than the max, you have to show specific need and it's not that easy.

You really, really need to talk to a good family law attorney as soon as possible.
