Legal Question in Family Law in Texas
We reported my husbands ex wife to CPS earlier this year for leaving her daughter home alone for hours and sometimes all night by herself she is 9. We also have been having a very hard time with his ex and her letting us see or even talk to his daughter who he has court ordered visitation with. She "let" us pick her up for summer visiatation on June 15th 2011. Throughout this whole time her mother has given us a hard time with demands and she threatens us if we dont do what she wants right away. Well a few days ago she told us that cps told her it was us who reported her. I know that it is illegal to reveal who the reporter is. She told me that the case workers supervisor knew and only wrote her up. Now if this is true what are our rights if they did tell her who called.?
If they told her for real then now she is going to make it harder on us or impossible to see her after this summer visit. She claims to have a lawyer Robert Gray in dallas ,tx on maple st. I think is what she said. She is constantly telling us that she is reporting to him that we dont let her talk to her daughter when in fact her daughter has talked to her almost everyday.
What can we do about the cps thing?
What can we do about her threats of not letting us see or talk to her after all this.
We dont have money for a lawyer and we desperately need one but make too much for one for low income. But we need to modify the visiatation and add court ordered weekly phone calls. Please help me.
1 Answer from Attorneys
You're going to have to hire an attorney. This is too complicated for you to try to wade through it on your own using free web sites. Call the Texas Legal Hotline and try to get a referral to an attorney who will handle your case at a significant discount. (Www.tlsc.org).
In a sense, it doesn't really matter what your rights are if you are not able to enforce them.
