Legal Question in Family Law in Texas

Self representation possible?

We've been sucked dry by my fiance's ex wife in custody battles, one of which we're currently in the middle of. No trial date set yet, just temp orders. Our attorney just withdrew from the case because we kept asking her not to send documents out w/o our prior review and she kept doing it and wasting our money.

My question is can my fiance' elect to represent himself in a petition for custody, or is it mandatory to have an attorney? If he can represent himself, can a lawyer back us up as co-counsel with stuff that's over our heads?

This trial greatly affects our lives, and no attorney will ever care about the outcome as much as we do. Just want to win and save some money while at it. Thanks!

Re: Self representation possible?

You always have the right to represent yourself, but long running, contested custody battles are not normally a place you would want to do it. That old adage about an attorney who represents himself having a fool for a client also applies in reverse. While you might find someone who would review your filings on a document by document basis, no one can second-chair you.
