Legal Question in Family Law in Texas

Rescheduling Discovery

Last October I my attoney asked for discovery from the opposing side. They made an offer so she would not have to do the discovery. We accepted and discovery was suspended but they did not follow through. instead the drug the case out and have made several diffrent offers which once accepted the change their minds on and the case draws on. I have instructed my attorney to reopen discovery because I know they will not end this case. The case is a simlple modification case but has drug on for 1.5 years now. My attorney, who has been less than truthful in the past tells me we have to set a hearing to reschedual discovery. Is this true, or do we just need to tell them we are starting the discovery again and set new dates for completion? Please help this case has drug on way to long.

Re: Rescheduling Discovery

you have a lawyer. No responsible and ethical lawyer will give you legal advice "behind his or her back." Either get matters straight with your lawyer or hire another lawyer.
