why can respondent request drug test

I have served my husband a petition for divorce as well as a restraining order through my attorney. I was just in court on 1-18 and I would like to know what grounds, if legal? can he request I submit to a drug test when I have never been arrested or connected otherwise with illegal drugs?

If you agreed to the condition in the temporary orders, then his grounds are that you agreed. If the drug test is the result of a hearing, and the judge ordered it, then it is based upon what is in the children's best interest. The judge has wide discretion in these cases to make conditions in visitation and conservatorship when there is evidence that the children's best interest and welfare is compromised. TCL
