Legal Question in Family Law in Texas
How to keep our retirement benefits to ourselves
I just filed the petition for an uncontested no fault divorce. My wife and I have been living apart for several years and have had separate finances. We agreed to just keeping what we have and avoid the trouble of splitting up property.
We already have the standard paragraph in the divorce decree that lists what will be awarded to the petitioner and what will be awarded to the responder. It starts off with ''the personal property currently in his or her possesion''. We added the house to my list. We were already living apart when I bought the house and she agrees to give up all interest in it. We also listed each others cars in our own lists. I don't think we had to list the cars but we did anyway.
How do we list our own retirement money? We want to say that neither of us will go after each other's retirement money later.

You truly need to pay an attorney to prepare this decree. There are already problems with the manner in which you have worded it, and in the long run, it will save you a great deal of money.
