retirement benefits

Do you have to mention retirement benefits at the time of a divorce? If you do not mention or include retirement benefits, does it bar you from getting retirement later?

Yes-they should be included. If you did not mention them in your decree you may have waived your rights to the retirement. You need to hire to a lawyer or contact the lawyer that represented you in your divorce.

Yes, you have to include retirement benefits. Most divorce decrees have language, that if any property is not disclosed or divided, then the property is automatically divided 50-50. If there is no mention, then you have to go back to court, especially if there is fraud involved. TCL
