Retirement

My parents divorced in 1979 and my mother was awarded 1/3 of my fathers military retirement. We are not on speaking terms with my father who is now a very wealthy man. He purposely may not draw his retirement out of spite. What can my mother do to receive her portion. She is 58 and he is 59.

Your mother may use the divorce decree to obtain her portion of the retirement. Her portion is independent of whether or not the ex-spouse receives his payment. She can check with the JAG office or dependents office at any military base.
