Revisting a divorce in reference to chold custody

How would I go about having the visitation changed in the matter of my daughter visiting her father on school nights? Also I would like managing conservatorship with my child, and increasing child support.

A motion to modify would have to be filed in the court that granted your divorce, unless you have moved to a different county more than six month's ago. If an agreement is reached, then it is quite simple. If no agreement, then it is a new lawsuit for custody, modification. For change of support, it is somewhat easier. To really answer your question, a lawyer would need to review your original divorce decree and any subsequent orders and discuss your particuliar facts. Good luck.

The best approach is to write your former husband and ask him to agree with you to the modifications of your arrangement which you seek.

If he won't cooperate, you will have to return to the Court which granted your divorce and ask for modification of the terms of your divorce Decree which you are concerned about.

It is best to wait at least one year before returning to court asking for modifications on the basis of a change in circumstances.
