Rights of the father

i am still married but separated from my husband. he is from another country and is now here illegaly because his visa expired. I do not wish for him to see my son and i want full custody of my son. Am i able to gain full custody of my son or does he have visitation rights? my son is only 6 months and my husband told me today that he had spoken with a lawyer and the lawyer told him he had the right to take my baby every other weekend by himself. Does he ?

You REALLY need to speak with an attorney with experience in immigration matters and family law matters. There are options and alternatives available here, which you may not be aware of. The issue of custody is normally a complex and difficult lawsuit, but it appears that you may have the more favorable position here. DISCUSS this with an attorney. TCL

Your case is complex and potentially dangerous. If your husband took your child to another country it could be almost impossible to get him back--it depends on the country. Contact and hire an attorney immediately. Your husband does have rights to his child but the possession and access must be addressed.
