what are the rights of a mother to take her children out or state without the father's consent if the parents are still married. he is verbally abusive to all.

Unless a court has said otherwise, each parent has equal rights. If you leave and then the father files for primary conservatorship, the fact that you left would not be helpful. If you leave and wait for six months without him filing anything, then you can file in the new state.

You really should talk to a qualified family law attorney about your options. The fact that he is abusive could help you.
