rights of a non biological father

My husband found out 3 years ago that his daughter was not his biologicaly. He is the only father the child has ever known. He also has son with this woman who is biologically his. The mom has just informed us that she is very ill and that she would like us to take in both children if she does not make a full recovery or in the case of her death. We agree completely. What do we need to do in order to make sure that we are given custody of the little girl even though my hysband is not her biological father? His ex does not have any living family other than a half sister. The children do not know that they have different fathers or that their mother is ill.
