What are my rights when it comes to seperation?

I live in Texas, married for 14 years and for the past four years i've been catching my wife cheating on me off and on. And just last week I found out she was at a guys house. I feel that I am done with this marriage. Whats involved are my two kids who I love and adore. There ages are 8 and 12 and they've been in the crossfire before. Earlier this year I confronted her about the guy she is cheating me with she left and took the kids with her to her moms house. When I wanted to see the kids she did not let me. She even told me that if I was to put one step on her moms property that she would call the police. Can she bar me from seeing my own kids? She often uses them as bargaining chips. We are still legal married, there are no papers or orders that say that I cant see my kids. I have no violent history, I don't even drink or smoke. Not even a moving violation ticket. A lawyer once said that I should put a temporary restraining order but now sure how that works or cost. Also what about child support in a separation or divorce. She make doubles what I make in a year and the kids is under her work insurance. Any suggestions or advice would be greatly appreciated.

If you file for divorce child support & visitation can be set up in temporary orders. I strongly siggest you get a lawyer if this issue is important to you. Good Luck.

If you live in the Houston area I would be glad to visit with you. Your current problem is that there are no existing Court orders. If you were to file for divorce, you could request the Court to have a hearing to enter temporary orders in the case. In that instance the Court would be in control, rather than your wife and mother-in-law. If you are interested in visiting more, please contact me.
