Legal Question in Family Law in Texas

What are my rights in this situation?

My husband left me over a month and a half ago and has not contacted me at all. I have no way of contacting him except my e-mail, which he will not respond to, nor will his parents speak to me. Currently I live in Japan and he went back to the states, but I will be moving stateside in July and plan on filing for divorce then. My first question is: How do I file for divorce if I can't even contact him and 2) Since he left all his property in my apartment (I live on US govt property) am I able to sell any of his things or do I have to pay to ship these back? Does he have a certain period of time he legally has to pick it up before I can dispose of it?

An alternative is to retain an attorney in the county where your husband currently resides, and have the attorney file for divorce based upon your husband's residency. You can ask for temporary orders regarding the disposal of the property. If the husband will not respond to the lawsuit, then the judge can enter the orders you propose.

You're in Japan; so the law over there covers his things. You are probably responsible for safekeeping them and don't you get your things moved by the State Dept. anyway? You can file for a divorce once you've established residency in the US again. Don't worry about the details until you know what state you'll be living in. Then you can try to do it yourself or have an attorney handle it.
