Legal Question in Family Law in Texas

My rights to my son??

A few months ago me and my girlfriend of 5 years split up. We have a 3 year old son. Since the split we have been sharing custody. I usually keep him from Thursday night to Sunday and she keeps him the rest of the week. A few weeks ago we got into a fight and she is now refusing to let me see him at all or talk to him on the phone. Right now I do not have the finances for an attorney to fight for custody. I would like to know what are my rights to my son without legal/court papers? As his father shouldn't I have the right to see and pick up my son whenever I want? Please help!!!

Re: My rights to my son??

Is your name on the birth certificate?

If not, then you have no more rights than a stranger off the street.

Visitation is never an issue until the parents start fighting.

You really need to file and establish your paternity and get court order visitation.

You can take the cops to her home and try to pick up the child, but many times the cops don't want to get involved. Additionally, they don't have the time to handle all of these civil cases.

I urge you to find the money to begin as soon as possible.

There are many attorneys that will begin your case for around $1,000 including filing fees.
