rights of a 17 year old

If she has been living for 14 mos. with another temp. guardian; doing great, passed school no problems, Moved back home w/Mom; Mom drinking heavily, 20 year old brother broke her arm and is begging to be allowed to live with former guardian; does she have any rights? Parent threatening to have her declared incompetent, removed all phones from house, etc. very bad situation. CPS doesn't want to be involved because she will be 18 in June

Amazing CPS doesn't want to be involved. Former guardians can apply for guardianship or custody. Sounds like somebody better find a lawyer.

Someone should have called the police on the broken arm.

If mom is drinking heavily and did nothing when a 20 year old was out of control, what is the likelihood she would even notice that the 17 year old was gone? At 17 she is no longer a runaway -- it is a matter of the family court order regarding conservatorship. Mom may not even contest the change of conservatorship.
