Does he have Rights?

My 17 year old nephew is trying to move out of his mother's house and in with his uncle who lives on a Marine base, in order for this to happen the uncle needs full custody of my nephew. His mother is stating that they need his father's signature as well. I need to know if this is true because the father is in prison, has only made one child support payment, and is not in the childs life at all, the mother has been the only supporter for him all his life,legally does the father have any rights, and does he need to sign as well?

Custody will have to be obtained through a court order. I don't know what the father's custody rights are, but if there has been no determination before now, he would have to have notice of the court hearing. He could sign, but he doesn't have to, if you get a court order.
