Legal Question in Family Law in Texas
Rule 11/Divorce decree - states that ex has to remove me from all debt. Due to his lack of finishing taxes and providing the tax statement to the bank, the bank will not acknowledge doing anything different with the note which would involve re-financing for him or taking me off the note entirely.
Rule 11 - Says that if his actions or lack of or the refusal of the bank to take me off (even after they receive taxes) transpires.....then I can take him back to court and the decree and property settlement division will be set aside to adjudicate all issues in court.
Where do I stand/what can take place if this is the case? The decree/rule 11 was signed April 2013 - no time limit was set on requirements.
