Legal Question in Family Law in Texas
School File Wrongful CPS Allegation
My daughter is 8 and has a neurological disorder. While on Kepra and Zonegran, she took her clothes off at school. The school is in constant contact with my husband and I. We do not feel she is getting the education she needs and have filed several complaints with the school. Our daughter has a neurologist, a neurosurgeon, a psychiatrist, and a neuropsychologist she sees on a regular basis and who are much more qualified in noticing if she is being abused. The school filed a sexual abuse CPS call against my husband and I after yet another hostile conflict with them on her education. What do I need to do to file a lawsuit against them and what criteria needs to be met in it being a successful lawsuit?

Re: School File Wrongful CPS Allegation
I am not sure that you have a cause of action.
You may want to contact Liberty Legal Institute in North Texas and ask for a referral to an attorney in your county that handles this type of case. Liberty Legal has had media attention in this area for filing suit against the school districts for unconstitutional conduct. Doubt if that applies to you, but they may have a viable referral for you.
