School Zone Change

I am in the middle of a modifiation and moving across town. I am primary parent and expect my daugter to go to school in my new neighborhood. (I am not changing districts.) My ex wants our daughter to change to the school in her neighborhood, since she has to move anyway and she has friends in that neighbhorhood. (Same district.)

She says a judge wouldn't hesitate to grant her the right to decide on the school even though she's not ''primary''.

Does that typically happen?

How interesting that she knows what an individual judge would or wouldn't do. Since you are primary, you make this decision. There are factors that will come into play in the modification proceedings. The age of the child, the preference of the child (if old enough), the advantages and disadvantages of the school changes, the best interest of the child.
