Legal Question in Family Law in Texas

I am seeking a divorce from my husband with whom I have 2 children who his mother has custody of. He has terminated his parental rights to them but I have not and still have visitation with them. I need to know if I need the court order for the termination, which was an order between he and his mother, to obtain the divorce, and if so, how do I obtain it since I was not a party to it?

He can't have an order terminating his rights and assigning them to his mother. You need to see the actual court order because I think either someone is not being truthful with you or you are misunderstanding the order.

His mother cannot adopt the children until YOUR rights are terminated, too. He might have had his rights terminated (I'm not sure of that either), but if so, that makes you the only remaining parent.

You need to get a copy of all these orders and take them to a local attorney to review for you and who can call the court to find out what has gone on. This whole thing sounds very suspicious to me.

Good luck!!
