Legal Question in Family Law in Texas

I'm seeking legal assistant regarding child custody for my 7 year old son who is living with his father after awarded custody by the Houston AG office due to me working overseas. I left Nov 2005 & returned every 4 months to visit; stayed home for 2 months from Oct 2007 - Dec 2007. I went back overseas from Apr 2008 - Sept 2008 & back home from Sept 2008 - June 2010 & just returned home for good Sept 2011. I also have full custody of my other son who is 10 years old (different father). I want custody of my 7 year old son & he wants to come back home with me. Do I have a chance to get my son back?

You have a chance, but you need a good family lawyer to help you. You must first prove that there has been a material and substantial change in circumstances. While you might think that this is easy in your case, remember that you were planning on coming home all along so that might not really be a change. Second, you must prove that this is in the child's best interest. You are asking the court to take him out of the only home that he really knows so that might be a challenge. If the facts are good, you might be able to do this. Good luck.
