Legal Question in Family Law in Texas

sell of house for divorce

My husband and I are in the process of getting a divorce. We have not filed yet, but will soon. We have both agreed to sell the house and use the proceeds to pay off what debt we share and split the remainder 50/50. My husband is wanting to use his mom as our realtor. Is there something I can do to prevent this from happening? I don't feel it is in our best interest, well mine, that she be our realtor. Is there something I can ask the lawyer to do to keep this from happening? Thanks so much.

Re: sell of house for divorce

You can refuse to sign the listing papers.

You cannot be forced to use a realtor that you don't want to use.

You can file for divorce. There are pros and cons of having the court handle the selling of the house. If you need details, please call me if you live in Harris County. It is far to complicated to discuss via email.

Good luck!
