selling a house after divorce

Divorced in 12/06. I got the house and our 3 kids lived with me. We got back 2gether in summer 08. Things didn't work out & he wouldn't leave. Contacted the police who informed me that now that I had let him co-habitate they couldn't make him leave. He ended up leaving but then informed me that he was going to have me ''served'' to evacuate since i was not paying the note (he consolidated it into a bankruptcy). i moved out becuase i didn't want my children booted out at any given moment and now he's trying to say that he is going to take money out of the equity to pay for all of these months i left it vacant when it sells and i will get nothing. i'm trying to get it ready to sell now, but i would like to know what my rights are to the equity. the original divorce decree says that we split it. can he really do what he's saying? also...i believe that he and his roomate are using drugs. he doesn't get the kids on a regular basis, but when he does i'm a nervous wreck. what can i do as far as their safety is concerned because i HAVE to let them go with him on his scheduled days.

This sounds really convoluted. I think I'd have to look at everything, including the bankruptcy. If you want to call the office to schedule a consultation, I'd be glad to talk to you.
