Legal Question in Family Law in Texas

Selling the house

Hi, My husband and I have been married for 5 yrs. The house was mine since 1998. We got married in 2001 and I paid the mortgage until May 2004. He sold his house and I do not know what he did with the money. In May 2004, we both decided that I would quit my job of $50,000 to take care of his son, which did not happen. From June '04 he started paying the mortgage. We refinanced 09/05 and put his name on the house. We are separated and he has not paid the mortgage since August. We are now going to divorce and I was wondering what he is entitled to. I quit my job and am only working p/t, making $800/mo. I have been trying to find a job to no avail. I will need to sell the house to have money. He has a job that he makes $80 - $100/yr. He is asking me for 2 yrs of mortgage pymnts ($1357/mo) and I think he should get at the most 1/2 of that. What are my rights please?

Thank you in advance for your help!

Re: Selling the house

You have the rights to protect your interest in this marital asset. It's much to complex to try to answer in e-mails. I sincerely suggest that you make an appointment with a family law attorney in your area to quantify the extent of your interest in this property if it's important to you.
