I am selling a rent house and my wife is refusing to sign. The house is in both of our names. I plan to divorce her after the sale of the house.

I haven't seen any of the deeds, but my guess is that you cannot sell it without her signature.

Basically, your choices are:

- Sell only your interest in the house. The purchaser then becomes a co-owner with your wife. Nobody's going to be interested in making this purchase.

- File a suit for partition of the rent house property. This is also not a good idea.

- File for divorce now. In the petition, ask that the rent house be awarded to you or, in the alternative, that the court order it sold.
