Legal Question in Family Law in Texas

Separated for awhile.

Hello! I have two children, a four year old and a two year old. We are currently living in Kansas.

I want to take my wife and two kids to Texas and they would stay with her parents for approximately six months.

I would come back to Kansas and wrap up my business and move it to

Texas. I intend to send her some money to help keep her on her feet during that time.

We don't want to get a divorce. Also, she wants to apply for food stamps and health care paid by the

state. She will - NOT - apply for Money Assistance.

What could she apply for in state

assistance that would avoid a child support order?

This question is about their policy. You and she need to learn their regulations regarding both of your incomes. Whether or not you are divorcing or separating, does not alleviate a parent's responsibility to their children. It sounds that she will be getting assistance from her parents and from you, and she may or many not be employed. Contact the food stamp agency, and contact CHIPS, to see if the children will qualify for assistance under those circumstances.

When she applies for any federal or state assistance, she will sign a statement giving the State of Texas(or any state in the US) the right to persue you for reimbursement from the taxpayers of the State of Texas.

Eventually, the TX A G office will come after you for repayment. It might take 2 or 3 years but they will sue you for reimbursement.

In summary, if anyone asks for assistance from any government agency, they give the government the right to go after the other parent for reimbursement.

What can they do to you?

Take all your tax refunds

Garnish your wages anywhere in the US

Revoke your driver's license

Revoke any professional license you have (plumber, electrician, attorney, doctor, etc.)

Ruin your credit

Auto-debit ANY bank account with your social security number on it - even kid's college funds if your ss# appears on the account

This debt will follow you the rest of your life until it's paid -- you cannot discharge it in bankruptcy.
