Legal Question in Family Law in Texas

I am going through a separation with my girlfriend of 8 years. We split up 3 months ago when we did she took my 2 year old son while I was at work. She told me a month later to come get the kids. The other child being my 11 year old step daughter. I picked them up and now she is coming to pick up her daughter and states she is taking my son with her. She will be arriving tomorrow night. Can she take my son if there is no custody agreement?

I am assuming that paternity has never been established (no court order).

If that is the case, you have no legal rights to your son, and the mother has 100% of all the parental rights that exist.
