Legal Question in Family Law in Texas

How to Seperate from Spouse

I remarried and moved into my husbands house. (he owns)

I now want to seperate for a while in hopes of solving some issues and reconciliation.

We are home at the same time only once a month for 5 to 6 days. (we both work out of state).

There is one week that I am home and he is not and then the next time I--name removed--home we have a week together. So I have two weeks a month at home. One when he is home and one when he is not.

If I do not go home during that week we are suppose to be together can I legally stay in the house the other week?

If he tells me to get out, how long do I have to find another place?

Can he prevent me from getting my personnel things at a later date?

Re: How to Seperate from Spouse

From what you have stated, it sounds like the house may be his separate property. There is no legal "separation" in Texas. As such, you need to contact a family law attorney. If my law firm can assist you with this or any other legal matter, please contact my assistant Stephanie at [email protected]
