Legal Question in Family Law in Texas
Seperation Agreement
Hello! I filed for seperation back in Sep '08, while I was in Iraq. My soon to be ex-wife never signed the agreement. I was just living up to what it said. She cleaned out the bank account and ruined my credit while I was deployed. I agreed to pay for her auto -insurance while we are still legally married. I'm struggling financially now, because she found other ways to screw me over financially. So, I called and told her I'm going to stop paying her auto-insurance come 1 June 2009. She then calls back saying that she signed the agreement and it's in the mail and that I'm legally required to pay it. Is there a time limit for her to sign this agreement? She's sat on it since September of 2008. Thank you for your time and have a wonderful day!

In Texas there are no legal separations. Why haven't you just gotten a divorce? Stop trying to do this yourself and hire a good family law attorney to help you before things get worse.
Re: Seperation Agreement
It is difficult to give you a definite answer because the reference to the "agreement" is a bit confusing to the lawyer's way of thinking.
Bottom line - nothing is binding on the parties until a court enters an order that state which party has which obligations. Signing an agreement is only part of the usual process.
You should consult with a lawyer to be sure what obligations, if any, you have at this time.
